Looks like someone who really can't take a joke has gone to the next level and hired a lawyer to sue the makers of the CKY4 DVD. Check out this letter we got from some lawyer on a budget that's sending CEASE AND DESIST notices by email. Funny stuff.
Subject: CEASE AND DESIST ALL SALES 0F "CKY4" DVD Dear Vendor/Distributor of the CKY4 DVD: I am counsel to John J. Hallinan, III and his employer, Food Emporium, Inc. t/a Dutton Mill Shop'N Bag ("DMSB"). On behalf of my clients, I am writing to demand that you IMMEDIATELY CEASE AND DESIST all further sales of the "CKY4" DVD. The CKY4 DVD was produced by and features Brandon "Bam" Margera and other performers, and I am informed that it is and has been distributed by VAS Entertainment, 411 Video Productions, Inc. and/or Rebel Waltz, Inc. t/a Slam Management. It was first shipped to vendors and distributors in or about October of 2002. The CKY4 DVD includes a segment called "Shopping Cart Drama" in which Mr. Hallinan and DMSB are portrayed in a very unflattering manner. Neither Mr. Hallinan nor DMSB consented to being included in the CKY4 DVD, and no releases were obtained from either of them by the DVD's producers. During the past several weeks I have repeatedly communicated my clients' objections to any distribution and sale of CKY4 DVD to the attorney for Bam Margera and his related companies, and we have placed the producers and distributors of CKY4 on notice of our concerns as well. They are aware that this e-mail is being sent to you, and will presumably be able to answer any questions you might wish to direct to them regarding this cease and desist demand. In addition to ceasing all sales of the CKY4 DVD, it will be necessary for you to make arrangements with CKY4's distributor, VAS Entertainment, or directly with me for the return of all unsold copies of the DVD. You may also be required to provide me with an accounting of all sales of CKY4 made by your company since October 1, 2002. In the next few days you may be receiving more specific instructions regarding those matters. Be advised that if you fail to immediately cease all sales of the CKY4 DVD and/or fail to return and account for all copies you have received and/or sold, my clients stand ready to seek injunctive and other appropriate relief against your company in an appropriate court. The VHS version of CKY4 does not contain the "Shopping Cart Drama" segment and my clients do not therefore object to sales of CKY4 in that format. Please acknowledge receipt of this e-mail by the close of business today and advise as to whether you will be complying with the demands made herein.
